CHILD WELFARE

CCAI MEMBERSHIP MEETING EXAMINES NEW DIRECTIONS

More than one hundred CCAI members participated in the October 23 and 24 Membership Meeting in Starved Rock, with the theme, Prepare to Change.

 

Freiderika Kaider, Director of the Candy Institute and faculty member at various universities, shared the concepts of Social Entrepreneurship. New social entrepreneurs have their roots in the history of community service and development. The history of commitment to social justice and economic empowerment is what feeds their passion for the creation of social business ventures. Commitment to community is strengthened by an equally profound commitment to using the power of free enterprise to redirect economic control back to individuals and organizations that, for the most part have relied on outside sources for funding and support. In identifying organizational assets and skills, a number of not-for-profit agencies have been able to develop self-sustaining, revenue producing ventures that cement an agency�s role in the community and provide assistance for clients. The group exercise helped identify organizational assets and skills, principles of high road development and high performance work and challenged child welfare agencies to think of their future directions in different ways.

 

Pat Miles, national known expert in Wraparound Service Concepts presented her ideas on the Role of Child Care Association Agencies in a Wraparound System of Care. Wraparound refers to a cluster of technologies that are community based, strengths based, need driven and family centered; aim for unconditional care and normalization; and practice cultural competency, collaboration and system integration.  Systems need providers in order to make change real at the practice level. Each community operates with a different perception of the role of providers in the change process that is driven by history, tradition and context. Assumptions of both the funding sources and the providers themselves will drive the direction and organization of provider participation. When perceptions are erroneous, the provider community must offer valid options for service delivery. Ms. Miles shared concrete examples of how Wraparound concepts have been successfully used to integrate children with serious mental illness and challenging behaviors into communities. This provides new challenges and roles and significant opportunities for high-end programs previously serving children from a residential care model.  Networking and diligent collaboration of providers are both essential to the success of the model.

 

Member agencies also examined the immediate future challenges of Working with A New State Government. In January, we will have a new Governor and state administration as well as a new General Assembly with potential shifts in party majority and leadership. Participants discussed the challenges ahead in the New Year, especially as Illinois becomes more enmeshed in budget problems. As we prepare to work with a new administration, we should assess the current administration regarding key issues surrounding children. The CCAI board will work with the President/CEO on completing this assessment and delivering it to the new Governor.

 

If you did not participate you missed unique opportunities to participate in key membership decisions and to examine new options for child welfare agencies in the future. We encourage all agency executives and senior staff to mark your calendars for the Spring Membership Meeting on March 20 in the Chicago area.  (MB)

 

COOK AGENCIES MEETING WITH JUDGE BISHOP

Cook area agency executives and senior staff are reminded that the next meeting of voluntary agencies with Presiding Judge Bishop is scheduled for Thursday, November 7, 2002, from 10:00 a.m.-Noon in the auditorium of Juvenile Court. We strongly encourage executive directors and executive staff to take advantage of this opportunity to meet and share concerns with the presiding judge of the Child Protection Division. (MB)

 

GENERAL

SACWIS GRANT AMENDMENTS

DCFS finally mailed out last week the revisions to the SACWIS Grant Amendments for FY03 and FY04 based on the revised seat count for your agency.  This seat count revision is the second and last adjustment that will be made in the SACWIS readiness grant amount.  The process for calculating the remaining years of the grant is different for agencies that began spending in FY01 (year 1-2-3 agencies) and those eligible to begin in FY02 (year 2-3-4 agencies).  In addition agencies that did not request reimbursement prior to the end of FY02 for expenses either in FY01 or FY02 will have their funding transferred to FY04.  These agencies will not receive any funding in FY03.  Agencies need to be aware that certification of SACWIS readiness is likely to occur prior to payment of FY04 reimbursement requests.

 

The calculation of the revised contract total amount is based on the new seat count times the initial dollars per seat of $2,727.  Agencies should sign and return the grant amendment as soon as possible.  If you have any questions, contact Steve Bradshaw at 217-747-7604 or e-mail [email protected].

DHS SENDS HIPAA INFORMATION TO DD COMMUNITY PROVIDERS

The Office of Developmental Disabilities within the Bureau of Policy, Planning and Program Development at DHS sent out a communication regarding their position on HIPAA compliance.  In this communication it stated that the Dept. of Human Services had requested the extension for the implementation of the transaction and code sets that was due Oct. 15, 2002.

 

Certain provisions of HIPAA also extend to business associate of covered entities.  Some business associates will be covered entities in their own right and will be directly regulated by HIPAA�s transaction and code sets, privacy and security rules.  Moreover, even business associates that are not covered entities will be indirectly regulated by HIPAA to some extent.  For example, all business associates must agree to comply with the privacy rule in connection with their use of protected health information.  In addition, many covered entities will require entities that submit data electronically to them � including business associates that are not covered entities � to do so using a HIPAA complaint format and using HIPAA transaction codes.

 

The Office of Developmental Disabilities believes that its payments to providers for developmental and treatment services, and the provisions of those treatment services which produces protected health information under the definitions contained in HIPAA, make ODD providers either health care providers or at a minimum business associates of ODD/DHS.  In this communication the Office of Developmental Disabilities further states that each provider must conduct its own analysis to determine its status and responsibilities under HIPAA and is responsible for its own compliance.

 

The privacy rule will require DHS to establish policies and procedures designed to ensure compliance with the rule and to establish a procedure for responding to complaints.  As a result the relevant portions of DHS rules will be revised to reflect changes mandated by HIPAA.  (JMS)
